These Terms of Use (“Terms”) govern your access to and use of the Lunaris Health PLLC website, patient-facing online services, telehealth services, appointment scheduling services, communications, and other services that link to these Terms (collectively, the “Services”).

“Lunaris Health,” “Lunaris Health PLLC,” “Lunaris,” “we,” “us,” and “our” refer to Lunaris Health PLLC. “You” and “your” refer to the individual accessing or using the Services, including patients and authorized representatives of patients.

By accessing the website, scheduling an appointment, creating or using a patient account, participating in a telehealth visit, or otherwise using the Services, you acknowledge that you have read, understood, and agree to these Terms.

1. Medical Emergencies

LUNARIS HEALTH’S WEBSITE AND TELEHEALTH SERVICES ARE NOT INTENDED FOR MEDICAL OR MENTAL HEALTH EMERGENCIES.

If you believe you are experiencing a medical or psychiatric emergency, call 911, go to the nearest emergency department, or contact an appropriate emergency service immediately.

Do not use website messages, appointment requests, email, text messages, the patient portal, or routine telehealth appointments for emergency medical care.

Lunaris Health cannot guarantee that electronic messages or appointment requests will be reviewed immediately.

2. About Lunaris Health Services

Lunaris Health PLLC is a healthcare practice providing clinical services through telehealth and other permitted methods of care.

Available services may include evaluation, diagnosis, treatment, medication management, preventive care, follow-up care, chronic-condition management, laboratory or diagnostic testing orders, referrals, patient education, and other healthcare services that fall within the treating clinician's professional scope of practice and applicable law.

The availability of a particular service depends on numerous factors, including your medical condition, age, physical location, clinician licensure, applicable state law, clinical appropriateness, and whether telehealth is an appropriate method of care.

Scheduling an appointment does not guarantee that any particular diagnosis will be made, treatment will be recommended, medication will be prescribed, laboratory test will be ordered, or referral will be issued.

3. Telehealth Services

Telehealth uses electronic communications to allow a healthcare professional and patient in different locations to communicate and provide healthcare services.

Telehealth may include secure video, audio, electronic messaging, review of medical records, photographs, laboratory results, diagnostic information, data supplied by the patient, and other electronic information.

Telehealth can improve access to healthcare but has limitations compared with an in-person examination.

In some circumstances, your clinician may determine that telehealth is not clinically appropriate or that an in-person examination, emergency evaluation, laboratory test, imaging study, specialist consultation, or other evaluation is required.

4. Patient Location and Provider Licensure

Healthcare professionals generally must be appropriately licensed or otherwise legally authorized to provide healthcare in the jurisdiction where the patient is physically located at the time care is delivered.

You agree to provide your true physical location at the time of every telehealth encounter.

You must not represent that you are located in a state or jurisdiction when you are physically located elsewhere.

Lunaris Health may decline, stop, reschedule, or redirect an encounter when the treating clinician is not authorized to provide care in the jurisdiction where you are physically located.

The availability of Lunaris Health services therefore may vary by state.

5. Telehealth Consent

By participating in a telehealth visit, you acknowledge and consent to receiving healthcare through telehealth.

You understand that:

  • Telehealth involves electronic communication between you and your healthcare professional.

  • Telehealth may be used for assessment, diagnosis, treatment, follow-up, medication management, patient education, and other clinically appropriate services.

  • Telehealth does not provide the same ability to perform a physical examination as an in-person visit.

  • Technical failures or interruptions may delay or prevent an encounter.

  • Although reasonable safeguards are used to protect health information, electronic communications carry privacy and security risks.

  • Information available to the clinician through telehealth may be incomplete.

  • Your clinician may determine that telehealth is insufficient and recommend in-person evaluation or a higher level of care.

  • No particular medical outcome can be guaranteed.

  • You may ask questions about telehealth before or during your visit.

By proceeding with a telehealth encounter, you voluntarily consent to receive care through telehealth.

6. Eligibility and Account Information

You agree to provide accurate, complete, and current information when scheduling an appointment, registering for services, completing intake forms, providing insurance information, or communicating with Lunaris Health.

Information may include your name, date of birth, contact information, physical location, medical history, medications, allergies, insurance information, payment information, and other information reasonably necessary to provide healthcare.

Providing incomplete, inaccurate, misleading, or false information may interfere with safe medical care and may result in cancellation or termination of Services.

If you are acting for another person, including where legally permitted for a minor or dependent, you represent that you have legal authority to do so.

7. Medical Information and Clinical Decision-Making

You are responsible for providing accurate and complete information relevant to your care, including:

  • Current medications and supplements

  • Medication allergies and adverse reactions

  • Medical and surgical history

  • Pregnancy status when applicable

  • Relevant laboratory or diagnostic results

  • Current symptoms

  • Other healthcare professionals involved in your care

  • Significant changes in your condition

Treatment decisions are made based on the information reasonably available to the clinician at the time of the encounter.

Your healthcare professional retains independent clinical judgment regarding diagnosis, treatment, medications, testing, referrals, follow-up, and whether telehealth is appropriate.

8. Prescriptions and Medications

A telehealth appointment does not guarantee that a prescription will be issued.

Medication decisions are based on the clinician's professional judgment, your medical history, the information available during the encounter, applicable prescribing standards, federal and state law, pharmacy requirements, and clinical appropriateness.

Lunaris Health does not guarantee that:

  • A particular medication will be prescribed;

  • A medication requested by a patient will be prescribed;

  • A controlled substance will be prescribed;

  • A pharmacy will have a medication in stock;

  • An insurer will cover a prescribed medication;

  • Prior authorization will be approved; or

  • A medication will be available at a particular price.

Additional evaluation, laboratory testing, medical records, monitoring, an in-person examination, or specialist consultation may be required before certain medications can be prescribed or continued.

9. Laboratory Testing, Imaging, and Referrals

Your clinician may recommend or order laboratory testing, imaging, specialist evaluation, or other services when medically appropriate.

These services may be performed by independent third-party facilities.

Unless specifically stated otherwise, fees charged by laboratories, imaging facilities, pharmacies, specialists, hospitals, or other third parties are separate from fees charged by Lunaris Health.

Insurance coverage and patient responsibility for those services are determined separately.

You are responsible for completing recommended testing and follow-up when needed for safe treatment.

10. Insurance Billing

Lunaris Health accepts certain health insurance plans and also provides self-pay services.

Acceptance of insurance does not guarantee that a particular service will be covered by your health plan.

Insurance participation may vary by:

  • Health plan

  • Insurance product or network

  • State

  • Provider

  • Service

  • Type of visit

  • Effective date of participation

You are responsible for providing complete and accurate insurance information before services are rendered.

When Lunaris Health participates with your insurance plan and the service is eligible for insurance billing, Lunaris Health may submit a claim to your insurer on your behalf.

Your health insurer—not Lunaris Health—ultimately determines coverage, allowed amounts, deductibles, copayments, coinsurance, exclusions, authorization requirements, and other plan benefits.

Verification of insurance benefits is not a guarantee of payment.

11. Self-Pay Services

Patients may receive certain Services on a self-pay basis when permitted by law and applicable insurance rules.

Self-pay may apply when:

  • You do not have health insurance;

  • Lunaris Health does not participate with your insurance plan;

  • You choose not to use insurance when legally permitted;

  • A particular service is not covered by your plan;

  • The service is excluded from insurance benefits;

  • Insurance information is not provided; or

  • Lunaris Health identifies a service as self-pay.

If you knowingly elect self-pay and instruct Lunaris Health not to submit a claim to your health plan where that election is legally permitted, payment will be processed according to the applicable self-pay rate.

Self-pay fees apply only to the Lunaris Health services identified at the time of scheduling or payment unless otherwise stated.

Pharmacy costs, medications, laboratory services, imaging, hospital services, specialist services, and other third-party expenses generally are not included.

12. Patient Financial Responsibility

If insurance is billed, you remain responsible for amounts assigned to you by your health plan, including applicable:

  • Copayments;

  • Deductibles;

  • Coinsurance;

  • Non-covered services;

  • Services denied because of inaccurate insurance information;

  • Services excluded by your health plan; and

  • Other amounts that your insurance plan identifies as patient responsibility.

The amount collected before or at the time of an appointment may be an estimate.

Because final patient responsibility may not be known until your insurer processes the claim, additional amounts may become due after the visit.

Likewise, if an overpayment occurs, adjustments will be made in accordance with applicable law and Lunaris Health billing procedures.

You are responsible for reviewing your insurance benefits and contacting your insurer when you have questions about your coverage.

13. Payment Authorization

When you provide a credit card, debit card, health spending account, or other accepted payment method (“Payment Method”), you represent that you are authorized to use that Payment Method.

You authorize Lunaris Health and its authorized payment processors to charge amounts that you have agreed to pay for Services, including self-pay charges and patient-responsibility amounts permitted by law.

If insurance is billed, your final financial responsibility may not be available until the insurer adjudicates the claim. When permitted and appropriately disclosed, outstanding patient-responsibility amounts may be charged to an authorized Payment Method or separately billed to you.

Patient balances are due within 15 days after the statement is issued. If insurance later changes or reverses its payment, any resulting patient balance is due within 15 days after notice. Patients should contact Lunaris Health promptly if they believe a balance is incorrect or need to discuss payment arrangements.

You agree to maintain accurate billing information and promptly update expired or changed payment information.

Nothing in these Terms authorizes Lunaris Health to collect amounts prohibited by applicable insurance contracts, federal law, or state law.

14. Appointment Cancellations, Missed Appointments, and Refunds

Appointment cancellation, rescheduling, missed-appointment, late-cancellation, deposit, and refund policies may be communicated during scheduling, checkout, registration, or elsewhere on the Lunaris Health website.

Any policy displayed or agreed to at the time of scheduling forms part of these Terms.

Fees may apply for late cancellation or missed appointments where permitted by applicable law and payer requirements.

Payments for completed healthcare services generally are not refundable merely because a patient disagrees with a clinician's medical judgment or because a requested medication, test, diagnosis, referral, treatment, or other outcome was not provided.

Nothing in this section limits any refund or adjustment required by law.

15. Privacy and Protected Health Information

Lunaris Health respects patient privacy and handles protected health information in accordance with applicable privacy laws, including the Health Insurance Portability and Accountability Act (“HIPAA”) when applicable.

Health information may be used or disclosed for purposes including treatment, payment, and healthcare operations and for other purposes permitted or required by law.

Additional information concerning the use and disclosure of protected health information is provided in the Lunaris Health Notice of Privacy Practices and applicable privacy policies.

16. Electronic Communications

By providing your telephone number, mobile number, email address, or other contact information, you consent to receive communications related to your care and use of the Services.

These communications may include:

  • Appointment confirmations;

  • Appointment reminders;

  • Patient portal notifications;

  • Billing communications;

  • Requests for information;

  • Care-related notifications;

  • Administrative messages; and

  • Other transactional communications.

Standard email and SMS text messaging may not always be secure.

Lunaris Health will take reasonable steps to avoid including unnecessary sensitive medical information in ordinary electronic communications.

Message and data rates may apply depending on your carrier.

Marketing communications, when used, will be handled separately as required by applicable law.

17. Website Information Is Not Individual Medical Advice

General educational information appearing on the Lunaris Health website, blog, social media pages, advertisements, videos, or other public materials is provided for informational and educational purposes.

Such information does not constitute patient-specific medical advice and does not establish a healthcare professional-patient relationship.

A clinical relationship is established only through the processes recognized by Lunaris Health and applicable law.

Do not delay seeking professional medical evaluation because of information you read on the Lunaris Health website.

18. Technology and Availability

Using telehealth requires appropriate internet access, equipment, software, and communication capabilities.

Lunaris Health cannot guarantee uninterrupted access to the website, patient portal, scheduling system, video platform, pharmacy systems, laboratory systems, payment systems, or other technologies.

Technical problems may occasionally result in delayed, interrupted, or cancelled services.

If a telehealth visit cannot safely or effectively continue because of technical issues, the clinician may attempt another communication method, reschedule the appointment, or recommend another form of care.

19. Third-Party Services and Links

The Services may contain or use links, technology, services, or resources operated by third parties, including pharmacies, laboratories, payment processors, scheduling systems, electronic health record systems, telehealth platforms, insurers, and other healthcare organizations.

Lunaris Health is not responsible for the independent operation, availability, terms, policies, pricing, or content of third-party services except to the extent required by applicable law.

Your use of third-party services may also be governed by that third party's own terms and privacy policies.

20. Acceptable Use

You agree not to misuse the Services.

You may not:

  • Impersonate another person;

  • Provide knowingly false information;

  • Attempt unauthorized access to patient, clinical, or administrative systems;

  • Interfere with website or platform security;

  • Introduce malware or harmful software;

  • Harass, threaten, or abuse clinicians, staff, patients, or others through the Services;

  • Scrape, copy, or harvest protected information through unauthorized automated means;

  • Use the Services for unlawful purposes; or

  • Attempt to defeat technical or security restrictions.

Lunaris Health may restrict or terminate access when reasonably necessary to protect patients, staff, systems, or the integrity of the Services.

21. Intellectual Property

Unless otherwise stated, the Lunaris Health website and its original content, branding, graphics, design, text, educational materials, and other materials are owned by or licensed to Lunaris Health PLLC and are protected by applicable intellectual-property law.

You may access and use website materials for personal, noncommercial purposes.

You may not reproduce, sell, publish, distribute, commercially exploit, or create derivative works from protected Lunaris Health materials without permission, except as permitted by law.

22. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE AND NON-CLINICAL DIGITAL SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

LUNARIS HEALTH DOES NOT WARRANT THAT THE WEBSITE OR DIGITAL SERVICES WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, SECURE, OR ERROR-FREE.

NOTHING IN THIS SECTION IS INTENDED TO DISCLAIM OR LIMIT PROFESSIONAL DUTIES THAT CANNOT LAWFULLY BE DISCLAIMED OR LIMITED.

23. Limitation of Liability

To the maximum extent permitted by applicable law, Lunaris Health is not responsible for losses arising solely from circumstances outside its reasonable control, including internet outages, third-party platform failures, telecommunications failures, unauthorized third-party activity, or a patient's failure to provide accurate information.

Nothing in these Terms waives, excludes, or limits any right, remedy, duty, or liability that cannot legally be waived, excluded, or limited under applicable healthcare or consumer-protection law.

24. Indemnification

To the extent permitted by law, you agree to be responsible for losses resulting from your unlawful misuse of the Services, intentional violation of these Terms, fraudulent activity, or unauthorized access to the Services using credentials under your control.

This provision does not require a patient to indemnify Lunaris Health for the professional negligence or unlawful conduct of Lunaris Health or its healthcare professionals.

25. Changes to These Terms

Lunaris Health may update these Terms periodically.

When material changes are made, the updated Terms will be posted with a revised effective date.

Your continued use of the website or Services after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

Changes to these Terms do not retroactively alter rights or obligations when prohibited by law.

26. Termination of Access

You may stop using the Services at any time.

Lunaris Health may restrict or terminate access to website or administrative Services when reasonably necessary because of misuse, fraud, security concerns, nonpayment where legally permissible, violation of these Terms, threatening conduct, or other legitimate reasons.

Termination of digital access does not eliminate obligations regarding medical records, continuity of care, patient abandonment, emergency care, or other professional responsibilities imposed by applicable law.

27. Governing Law

These Terms will be interpreted under applicable United States federal law and the applicable state law governing Lunaris Health PLLC and the healthcare services provided, except where the law of the state in which the patient receives care requires otherwise.

Because telehealth care may occur across multiple jurisdictions, state-specific healthcare laws, patient protections, professional-practice requirements, and insurance requirements may apply regardless of any general choice-of-law provision contained in these Terms.
